CASA GIRASOL TERMS AND CONDITIONS OF VILLA RENTAL
1) Rental Contract. The parties to the rental contract are HRBL who own the villa and the named individual whose details are completed on the Booking Form hereinafter called the HIRER. The HIRER must be a responsible adult of 21 years of age or more prepared to accept responsibility for the well being and conduct of the party hiring the villa.
All bookings are accepted by HRBL subject to these Terms and Conditions that are deemed to have been accepted by the HIRER on behalf of all persons in the party as shown on the Booking Form. No modifications to the Terms and Conditions can be accepted without prior written agreement by HRBL.
2) Confirmation. Your booking is confirmed when a) HRBL have received payment of the deposit together with the completed Booking Form and b) the HIRER has received written confirmation of the booking details.
3) Payment. Your booking must be accompanied by a payment of 30% of the total rental costs. This can be made either by cheque (Made payable to "HRBL") or by electronic transfer to our account (see Booking Form for details). We will then send you written confirmation of our receipt together with notification of the due date of the balance of payment, which must be received by us and cleared no less than 8 weeks prior to commencement of the rental period. If your booking is made less than 8 weeks prior to the rental period, payment must be in full.
If we do not receive your balance of payment as described above, we may cancel your booking without prejudice to our claim for cancellation charges, see clause 4.
4) Cancellation. All cancellations of bookings must be in writing to HRBL at the address shown on the Booking Form and received by us no less than 8 weeks before the commencement of the rental period. If cancellation is prior to this deadline, only the deposit will be forfeit. If we receive cancellation less than 8 weeks prior to the rental period, the full hire cost must be paid.
5) What is included in the rental agreement. The cost of water and electricity, maintenance of the swimming pool and garden and a full inventory of equipment and utensils. See Booking Form and Information Sheet regarding linen and towels. Please note : no items to be removed from the villa during your stay. Neither towels nor other items to be taken on the beach.
6) What is not included. The price you pay does not include any personal insurance, travel, transportation or airport to villa transport. Nor does it include bottled gas or food. If you select to use air conditioning/warm air heating on the Booking Form, or subsequently by prior agreement with us, meter readings will be taken at the beginning and end of your rental period and electricity consumed will be charged to you at €0.20 per kilowatt hour.
7) Occupation. Only persons identified on the Booking Form may occupy the villa. The villa cannot be re-let/sub-let without the written approval of HRBL. By confirming the accuracy of the information provided on the Booking Form, the HIRER agrees to take personal responsibility to ensure that all members of his/her party abide by these Terms and Conditions.
8) HIRER's responsibilities. The HIRER must take all reasonable care of the property and its contents and ensure that all members of his/her party do the same. The property and all equipment, fixtures, fittings and utensils etc. must be left clean and tidy at the end of the rental period. In particular, the HIRER must ensure that all members of the party behave in a manner which causes no offence to neighbours or damage to property belonging to others, including HRBL. This specifically includes unacceptable antisocial behaviour and pollution or contamination of the swimming pool or septic tank.
Please ensure rubbish is removed from the villa to communal bins on a daily basis. To assist with Saturday morning linen changes, kindly strip beds and leave linen and towels ready for collection. POOL SAFETY.
This is of the utmost importance. The HIRER must at all times be solely responsible for ensuring that:-
a) No diving takes place (notice on display at the deep end).
b) No irresponsible behaviour takes place by the pool.
c) No glasses or beer cans to be used by the pool. Please use the plastic glasses.
d) No running by the pool area. The pool area has non-slip tiles. The villa interior does not have non-slip tiles, we advise that children do not run through the villa when still wet.
9) Damage to villa. Except in the case of normal wear and tear, the HIRER will be responsible for any damage to the villa or its contents caused by any member of his/her party. Such damage must be reported without delay to our local representative, or directly to HRBL. The cost of repair or replacement must be agreed with and paid for. A figure of £150 (€225) is held against damage to the property, its contents, gardens and swimming pool or excessive cleaning required. HIRER accepts that any such costs in excess of £150, will be his/her sole legal responsibility under the terms of this contract.
10) Rights of access. The representatives or sub-contractors of HRBL shall have right of access to the property during the period of hire, with due regard to the convenience of the HIRER, for the purpose of inspection of the property and to carry out any essential repair or maintenance work. HIRER agrees to notify our local representative immediately if equipment failures are apparent.
11) Responsibilities. Neither HRBL or their local representatives can be held responsible for any circumstances beyond their control (force majeure), including but not limited to, mechanical breakdown, bankruptcy or failure of public services or any third party service provider. The HIRER undertakes that no person will suffer anything to be done which would endanger the policy of the villa owner's insurers in respect to the villa and its contents, including the garden and swimming pool. This includes but is not limited to, ensuring safekeeping of the villa keys and ensuring that the villa is left secure and locked during periods when the HIRER's party is away from the villa. It also specifically includes that the HIRER ensures that no smoking takes place inside the villa and that no fire risk is created.
12) Injury and damage. The HIRER will take all necessary and reasonable precautions to avoid damage to persons and property during the rental period. It is particularly emphasised that swimming pools are a potential source of risk to individuals and that the young and infirm must be constantly monitored whilst in or around the pool. The Owners cannot be held responsible for damage or loss caused by HIRER's negligence or omission.The Owners do not accept any liability for injury, damage or loss caused by any reason or for any claim made by the HIRER, his or her party or persons visiting the property as guests of the HIRER.
13) Maximum number of persons. HRBL and its local representatives reserve the right to refuse admittance to the villa if the HIRER is in breach of the declaration regarding party members made on the Booking Form, unless modified by prior agreement with HRBL in writing.
14) Information. All information given by HRBL or its representatives is given in good faith and is based upon the information available at the time of writing. All reasonable measures have been taken to ensure the accuracy of any statements, but we are not liable for any variation or inaccuracy however caused.
15) Occupancy. The villa will be available from 16.00 hours on the day of arrival and must be vacated by 09.30 hours on the day of departure. Bookings run from Saturday to Saturday. Any variation to this must be confirmed in writing by HRBL.
16) Keys. Detailed instructions for receipt of keys and directions to the villa will be provided immediately after receipt of the payment in full.
17) Complaints. In the unlikely event of a complaint about the villa, its contents or our service during the rental period, it must be reported immediately to our local representative who will take all reasonable steps to resolve the matter. Neither HRBL nor our local representatives shall have any liability for complaint after the completion of the rental period.
18) Force Majeure. In this contract, the term 'force majeure' means any event which we the supplier of service(s) in question could not, even with due care, foresee or avoid. Such events may include, but are not limited to, war, threat of war, civil unrest, commotion or strife, hostilities, acts of terrorism, strikes or other industrial disputes, natural disasters, fire acts of God, technical problems with transportation, closure of ports or airports, quarantine, epidemics, weather conditions, government action or other events outside our control.
19) Law & Jurisdiction. In the event of a dispute concerning the terms and implementation of this contract, the courts of law of England will have jurisdiction.
20) Alterations and cancellations by HRBL. In the unlikely event that the villa becomes unavailable due to circumstances beyond our control, then the HIRER will be offered alternative equivalent accommodation (if available) or a full refund. Any such refund is restricted to the villa hire cost and we are not liable for any other charges regarding travel, or booking fees etc.
21) Insurance. The villa hire cost does NOT include any personal insurance of any kind. IT IS A CONDITION OF BOOKING THAT INSURANCE IS TAKEN OUT BY THE HIRER AGAINST CANCELLATION AND IT IS STRONGLY RECOMMENDED THAT PERSONAL ACCIDENT AND MEDICAL INSURANCE ARE ALSO TAKEN OUT.
